Terms & Conditions
The following general terms & conditions for travel govern the relationship between you (hereafter referred to as “the client”) and us Climb Bike Hike/CBH (hereafter referred to as “the operator”).
For Climb Bike Hike/CBH safety of the passengers is number 1 priority therefore Climb Bike Hike/CBH reserves the right to adjust, change or cancel itineraries, and other services in case of any events of force majeure occurring during the program.
Services Rendered
The scope of services rendered is defined by the reservation confirmation and the description of included services found on our website (www.climbikehike-ec.com)
Extreme care is taken in the contracting of all services, however Climb Bike Hike/CBH does not take responsibility for the errors or omissions of the suppliers or services. In the unlikely event that a supplier fails to honor their contract with us, we reserve the right to alter, change or cancel such services. When such a change occurs, we will endeavor to substitute comparable services, although we will not be liable for any difference in the quality or enjoyment.
Reservations
The easiest way to make a reservation is to contact us by e-mail to This email address is being protected from spambots. You need JavaScript enabled to view it.
A non-refundable deposit is payable at the time of booking. Upon entering into a program confirmation, the client agrees to make a 20% down payment of the total program price. If the total due is less than USD 500 or if the trip is booked less than 30 days prior to the start of the trip, the entire amount is due immediately upon receipt of the invoice. Once we have received your deposit, we will confirm your space and send you a confirmation e-mail containing your trip itinerary, invoice, clothing and equipment recommendations, general information on your destination(s), and forms for you to complete, sign and return to us. Your final trip itinerary will be sent approximately 2-3 weeks prior to departure.
All payments must be received 60 days prior the start of the tour. If payment is not received on time, Climb Bike Hike/CBH reserves the right to assume that the reservation is cancelled.
Additional Costs
All additional costs that arise as a result of, or in connection with, changes in the itinerary that are caused by the client are to be paid by the client immediately to the respective claimant. Such additional costs include, but are not limited to, costs arising because of the client’s late arrival for a flight or scheduled tour or because a hike has to be aborted prematurely because of a client’s illness or accident (e.g., costs for airlifting a client, hospital or hotel costs for a client or travel companion).
Some tours require a minimum of participants. If you are alone or in a group with less people that is required, we will establish another group with other people to be able to get the training or the tour to work. In the case that we cannot reach the minimum number of participants and if it is possible, a supplement will be offer to you in order not to cancel the allowance.
- Payment and Cancellations
Payments have to be transferred to Climb Bike Hike/CBH bank account in Ecuador
Clients will be responsible for any extra costs for international money transfers and will make sure Climb Bike Hike/CBH receives the full amount due.
If a tour is cancelled, the following penalties will apply:
Cancellations from 90 days from the start of the tour: 300 USD per person
Cancellations from 60 to 45 days from the start of the tour: 40% of the total amount.
Cancellations from 45 days or less from the start of the tour no refund guarantee. (We will consider to give some refund depending of the case and the reason for the cancellation)
Cancellations that include a reservation on a yacht in the Galapagos Isles are subject to the cancellation policies of the yacht.
If a client decides to end the program for any reason, client will not receive any reimburse whatsoever.
We will not grant partial refunds for any unused trip arrangements—voluntarily missed meals, sightseeing, transport, etc.—after the trip has commenced, or any refunds to trip members who do not complete any portion of the itinerary for whatever reason
Refunds
If a passenger wants to cancel a tour because of serious illness or the death of a spouse, parent, sibling or child, he will notify Climb Bike Hike/CBH by email at: This email address is being protected from spambots. You need JavaScript enabled to view it. providing proof of the reason of cancellation. Climb Bike Hike/CBH will refund the amount paid, subtracting 30% for administrative costs and other costs already made for the client.
In case of a no-show or a delayed flight or if the passenger is late because of a delay in land transport, or if he voluntarily decides to cancel the tour, no refund will be made.
If the passenger wishes to change the itinerary he will have to pay for the additional costs as a result of the change. No refund will be made for services in the original itinerary he decides not to use.
Special cancellation rates apply to yacht charters.
In addition, the operator can charge the client for all actual additional costs arising because of the client’s cancellation (applies to all trips). It is the client’s burden to prove that no damage or smaller damage than assessed by the operator has occurred. Please note that failure on the part of the client to start a trip, without express written cancellation notice, does not constitute a cancellation of the contract and that the client therefore remains liable for the full cost of the trip.
Changes to Itinerary
We take great care to ensure the accuracy of our itineraries; however, circumstances beyond our control may require changes to tour content and changes in tour dates. In the case of content change, you must refer to the tour itinerary included with your final documents package as it may have been updated since you booked your trip. In the case of a shift in dates, we will notify you as early as possible of such changes so that necessary adjustments can be made. Changing conditions in the field may also necessitate itinerary modifications after the trip has departed. Tour members are responsible for all increased costs associated with en route itinerary changes or changes in means of conveyance, hotels, Tour Leaders, etc. Land Only clients will be responsible for any costs associated with changes tour start / end point/s.
Insurance
Trip cancellation and interruption insurance is optional but highly recommended. Travel insurance offers peace of mind and financial protection against unforeseen events that might prevent your travel or completion of your trip.
To reduce any risks associated with a trip, we recommend that you take out a travel insurance policy (emergency travel expenses, loss of luggage, accident etc.) if you do not have sufficient insurance coverage for such events.
Travel Docummentation
It is clients’ responsibility to ensure that he/she has the correct passport and visas to gain access to Ecuador. If he/she fails to do so, we have no liability for any cost, loss or damage which he/she may suffer, nor will we refund the cost of any unused portion of client’s travel arrangements.
We cannot accept responsibility for any failure to comply, resulting in any costs or fines being incurred and we advise the client to check with the passport office or the consulate in question if the client have any queries.
Fitness and Medical Insurance
If you will be 75 or older at the time of travel you will be required to have a physician complete and sign a questionnaire that affirms your suitability for your chosen tour. Certain tours, including those involving high altitude and/or walking/treking, require a medical questionnaire to be completed and signed by a physician regardless of age. We require that all passengers be medically insured. Once you have been confirmed on a trip that requires a medical certificate signed by a doctor, normal cancellation penalties apply if your doctor does not sign the certificate.
It is client’s responsibility to ensure he obtains proper and detailed medical advice at least two months prior to travel for the latest health requirements, recommendations for destination and any costs.
Client's Liabilities
Passenger agrees that he/she will participate in special activities such as climbing, biking, hiking snorkeling and kayaking, only to the extent of passenger’s physical ability and qualification by experience and agrees to assume all the risks of such activities, as well as all risks arising out of passenger’s personal medical condition prior to the voyage, whether or not disclosed to the operator.
Clients are aware that this is a release of liability and a contract between client and Climb Bike Hike/CBH and that client signs it on their own free will. This agreement shall serve as a release for the client, client’s heirs, administrators, executors and for all members of clients’ family including any minors accompanying the client.
Climb Bike Hike/CBH call client’s attention to the fact that expeditions, mountain climbing, trekking, biking in outlying and high altitudes could be dangerous. Accidents losses, injuries, delays as well as other damages are possible and participation in the tour is at your own risk.
Climb Bike Hike/CBH does not take responsibility for events such as accidents, strikes, riots, earthquakes, climatological or natural events, safety conditions, political events, and denial of entry, health affairs damages or any delays and every other form of force majeure that might occur during the tour.
Behavior
A booking is accepted on the strict understanding that client will comply with the laws, customs, foreign exchange, drug and all other regulations of Ecuador, as well as all hygiene, safety and security rules. If client commits any illegal or if the guide considers client’s behavior to be disruptive, threatening or abusive or is causing or likely to cause danger, distress or annoyance to others (reasonable opinion) we may terminate client’s travel arrangements without any liability on our part. If this occurs, client will become responsible for return transport. If client is affected by any condition, medical or otherwise, that might affect clients’ or other people’s enjoyment of the program, client must advise us of this at the time of booking.
Participation Requirements
All clients are expected to declare prior to booking that they are fit and able to complete the itinerary of their chosen program. Anyone suffering from mobility impairment, illness or disability or undergoing treatment for any physical or medical condition must declare the true nature of such condition at the time of booking and make arrangements for the provision of any medication or other treatment which may be required during the program.
Damages & Loses
In case the client, loses or damages any property or equipment provided the client will have to pay the total amount for a replacement or the repair of the lost or damaged property or item.
- Refounds
Climb Bike Hike/CBH will not extend a refund in any of the following situations:
Changes to itinerary before or after departure.
Mechanical issues affecting any form of transport on the trip.
Substitution of facilities or personnel.
Late arrival or no-show of the client.
Client’s decision to leave the tour early or miss any activities / meals / accommodations or services during the tour.
The client travelling without necessary documentation including passport, visas, immigration papers or vaccination certificates.
Price differences paid by different passengers aboard the same tour including special last minute rates.
Decisions by any third party that affect the normal running of the tour including by the operator, Ecuadorian government or national park authority.
Any other circumstances on clients’ tour arising beyond the control of Climb Bike Hike/CBH.
Claims
Without prejudice to any price reduction or contract termination, the client preserves his/her right to claim nonperformance damages unless the defect was caused by circumstances for which Climb Bike Hike/CBH cannot be held accountable.
Deadline for Claims
Clients who want to present a claim because of a defect or request a refund or compensation must submit their claim to Climb Bike Hike/CBH in writing within 30 days after the ending date of the program. Claims must be accompanied by pertinent documentation and/or supporting evidence from the tour guide, or the service provider.
Applicable Law & Jurisdiction
The laws of Ecuador govern the legal relationship between the client and CLIMB BIKE HIKE/CBH. Quito, Ecuador, is the exclusive venue for all legal claims against CLIMB BIKE HIKE/CBH
